Terms and Conditions

1. Introduction

Welcome to Traista ("we," "us," "our," or "Company"). These Terms and Conditions ("Terms") govern your use of our website, platform, and services. By accessing or using Traista, you agree to be bound by these Terms. If you do not agree to any part of these Terms, you may not use our services.


2. Use License

Permission is granted to temporarily download one copy of the materials (information or software) on Traista for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

  • Modify or copy the materials
  • Use the materials for any commercial purpose or for any public display
  • Attempt to decompile or reverse engineer any software contained on the platform
  • Remove any copyright or other proprietary notations from the materials
  • Transfer the materials to another person or "mirror" the materials on any other server

3. Disclaimer

The materials on Traista are provided on an 'as is' basis. Traista makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.


4. Limitations

In no event shall Traista or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on Traista, even if Traista or an authorized representative has been notified orally or in writing of the possibility of such damage.


5. User Accounts & Responsibilities

If you create an account on Traista, you are responsible for maintaining the confidentiality of your account information and password. You agree to accept responsibility for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account or any other breaches of security. You must not provide false or misleading information during registration.

Age & Legal Capacity

By using Traista, you represent and warrant that: (a) you are at least 18 years old or an emancipated minor; (b) you have legal capacity to enter into this agreement; and (c) if you are using this service on behalf of an organization, you are authorized to bind that organization to these Terms.

Competitor Restrictions

You may not access Traista if you are a direct competitor of Traista without prior written consent. Additionally, you may not access this service for the purpose of monitoring our availability, performance, functionality, or for benchmarking or competitive analysis. Unauthorized competitive access may result in legal action.

Third-Party Agent Restrictions

You may not use Traista to submit or manage lost item claims on behalf of third parties, or to operate the service as a commercial agent for other parties without our express authorization. Specifically, you may not charge fees to customers to act as an agent for claim management or monitoring. Violation of this policy may result in account termination and legal action.


6. User Content & Lost Item Claims

By submitting information about lost items, found items, claims, or any other content to Traista, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and distribute such content in connection with providing our services. You represent and warrant that:

  • You own or have the right to submit the content
  • The content does not violate any third-party rights
  • The content is accurate and truthful to the best of your knowledge
  • You have the authority to provide any personal information included

7. Prohibited Conduct

You agree not to:

  • Violate any laws or regulations
  • Engage in fraudulent or deceptive conduct
  • Harass, abuse, or threaten other users or our staff
  • Attempt to gain unauthorized access to our systems
  • Use the platform for any commercial purpose without authorization
  • Spam, phish, or distribute malware
  • Impersonate another person or organization

8. Privacy & Data Protection

Your use of Traista is also governed by our Privacy Policy. We are committed to protecting your personal information. All personal data is stored securely and handled in accordance with applicable data protection laws. We will never share your information with third parties without your consent, except as necessary to provide our services or as required by law.


9. Payment Terms & Shipping Costs

Traista's core platform is free. When items are ready to be returned, customers may choose to pay for shipping labels through our partner payment processors (currently Stripe). By initiating a payment, you authorize the charge to your selected payment method. Shipping costs are determined by the carrier and are the responsibility of the customer. Traista acts as a facilitator only.


10. PCI Compliance & Payment Security

Traista does not directly store credit card information. All payment processing is handled by Stripe, which is PCI DSS Level 1 compliant. By using Traista's payment functionality, you agree to Stripe's terms of service and privacy policy.


11. Intellectual Property Rights

All content on Traista, including text, graphics, logos, images, and software, is the property of Traista or its content suppliers and is protected by international copyright laws. You may not reproduce, distribute, or transmit any content without prior written permission from Traista.


12. Third-Party Links & Websites

Traista may contain links to third-party websites. We are not responsible for the content, accuracy, or practices of external sites. Your use of third-party sites is governed by their terms and privacy policies. We encourage you to review those policies before providing any information.


13. Limitation of Liability

To the fullest extent permitted by law, Traista shall not be liable for any indirect, incidental, special, consequential, or punitive damages, regardless of the cause and whether such liability arises from breach of contract, tort, strict liability, or otherwise. This includes but is not limited to lost profits, data loss, or business interruption.


14. Indemnification

You agree to indemnify and hold harmless Traista, its officers, directors, employees, and agents from any claims, damages, or costs arising from your use of the platform, your violation of these Terms, or your infringement of any third-party rights.


21. Phone/SMS Contact Consent (TCPA Compliance)

By providing your phone number or mobile device number, you explicitly consent to receive calls, text messages (SMS), and other electronic communications from Traista regarding your lost item claims, recovery status, shipping information, and account notifications. This consent is in accordance with the Telephone Consumer Protection Act (TCPA).

Auto-Dialer & Pre-Recorded Messages

You acknowledge and agree that Traista may use auto-dialers, artificial intelligence, and pre-recorded or synthesized voices to deliver messages. Standard message and data rates may apply through your service provider. You can opt out of SMS communications by replying STOP to any text message or by contacting us at support@traista.com.

Call Recording

By calling Traista, you acknowledge that we may record or monitor calls for quality assurance, training, security, or other business purposes without further notice. Recorded calls may be retained for up to 90 days.


22. Hazardous Materials & Shipping Restrictions

Traista cannot accept, process, or ship items containing hazardous materials, including but not limited to: lithium batteries, electronics with built-in batteries, flammable materials, chemicals, explosives, radioactive materials, or items prohibited by federal, state, or international shipping regulations. Customers who attempt to ship restricted items are solely responsible for any fines, penalties, or legal consequences.

Carrier Liability Limitations

Traista uses licensed shipping carriers for item delivery. Carrier liability is limited to their published rates, typically $100-$300 per package regardless of actual value. Traista is not responsible for loss, damage, or delay in transit. Customers may purchase additional insurance at the time of shipment. For claims, customers must contact the shipping carrier directly within the required timeframe.


23. Shipment Delays & Refund Policy

Expected delivery times are provided as estimates only and are not guaranteed. Traista is not liable for delays caused by carriers, weather, customs, or other circumstances beyond our control. If an item does not arrive within 30 days of shipment, the customer may request a refund of shipping costs paid (less a certain processing fee). Refunds are processed within 5-10 business days.

Refund Conditions

Refunds are only issued for: (1) items verified as lost in transit by the carrier, (2) claim verification disputes where Traista determines the organization was at fault in processing delays, or (3) duplicate payments. Refunds do not include organization service fees or administrative costs. Once a refund is approved, payment will be returned to the original payment method within 10 business days.


24. DMCA Copyright Notice & Procedures

If you believe your copyrighted work has been infringed upon through Traista, please provide a written notice containing:

  1. Your physical or electronic signature
  2. Identification of the copyrighted work you claim has been infringed
  3. Identification of the infringing material and its location on the platform
  4. Your contact information (address, phone, email)
  5. A statement that you have a good faith belief the use is unauthorized
  6. A statement that the information is accurate under penalty of perjury
  7. Your signature acknowledging you are the copyright owner or authorized representative

25. De-identified Data Ownership

You acknowledge and agree that Traista retains ownership of all de-identified, aggregated, and anonymized data collected through your use of the platform. This includes historical claim data, recovery statistics, matching algorithm insights, user behavior patterns, and other analytics. Traista may use this data for business purposes, product development, research, and to improve our services. De-identified data does not include personally identifiable information (PII) and remains Traista's property in perpetuity.


26. Dispute Resolution & Binding Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms, the Traista platform, or your use of our services shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) in accordance with the AAA's Commercial Arbitration Rules.

Arbitration Venue & Procedures

The arbitration shall take place in Maricopa County, Arizona (or remotely via video conference at the arbitrator's discretion). Each party shall bear its own legal fees and costs; however, if you are the prevailing party in the arbitration, Traista shall reimburse reasonable attorney fees and costs. The arbitrator may award any relief that would be available in court under applicable law. The arbitration award shall be final and binding and may be enforced in any court of competent jurisdiction.

Exceptions to Arbitration

Notwithstanding the above, the following matters are excluded from arbitration: (a) claims brought in small claims court (if within that court's jurisdiction), (b) injunctive relief to prevent infringement of intellectual property rights, and (c) disputes concerning whether a matter is arbitrable.


27. Governing Law & Arizona Jurisdiction

These Terms and Conditions are governed exclusively by the laws of the State of Arizona, without regard to its conflict of law principles. For any legal actions not subject to arbitration, you agree to submit to the exclusive jurisdiction of the state and federal courts located in Maricopa County, Arizona. You waive any objection to venue and any claim of inconvenient forum. Traista may bring action in any court of competent jurisdiction.


28. Modifications to Service

Traista reserves the right to modify or discontinue our services at any time. We will make reasonable efforts to notify users of significant changes. Continued use of the platform following notification constitutes acceptance of modifications.


29. Termination

We reserve the right to terminate or suspend your account and access to Traista at any time, for any reason, including but not limited to violation of these Terms, fraudulent activity, or conduct harmful to other users.


30. Changes to These Terms

Traista reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting to the website. Your continued use of Traista following any modifications constitutes your acceptance of the updated Terms.

32. Entire Agreement

These Terms and Conditions, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Traista regarding your use of our services and supersede all prior agreements and understandings.
